A Last Will and testament is vital – but setting up trusts can ensure that there is something to leave when you die, not just a Last Will and few assets.  Setting up a trust can preserve the benefit of your hard work for your children, grandchildren and great grandchildren.  Or your favourite charity. In most cases Wills do very little to keep your assets safe and sound for your family, and all your hard work can very easily be lost. Property Trust Wills may have a part to play, but they are fairly limited.  We can advise you on the cost of setting up a trust as compared with property trust Wills

Please note: Property Trust Wills are not the same thing as setting up a Family Trust of the type we are talking about here.   Don’t buy a cheap Property Trust Will thinking it is the same thing! This type of Will has its’ place, which we will be happy to explain to you, but a full trust is generally preferable.

Setting up family trusts: are any of these issues a concern?

  • Protecting family members who may not be able to look after their finances wisely or
  • Or who might lose benefits if they inherit direct. Tax flexibility – reducing  inheritance tax for children and grandchildren.
  • Children who are better off than you – but grandchildren etc who need help.
  • Where an inheritance might tip the balance in favour of a divorce/ split (and half of your childs’ inheritance be lost.)
  • Protecting family assets against unexpected future creditors. The most common is the family property trust.
  • Helping family members get started in life with grants or loans – perhaps for university fees or house deposits – and recycling the cash for up to five generations, starting with your children, should they need help.  
  • It is very common for a widow or widower these days to remarry, not wishing to be alone for a decade or two. This very often results in all of the families assets going to people totally unconnected to your current family. A family trust can prevent this happening without disadvantaging the survivor.

Family trusts have a great deal to offer ordinary families…. but the wealthy are 1000 years ahead of most of us in setting up a family trusts…

That is just what the rich have been doing to keep their wealth cascading down the generations.  With modern technology, we are helping lots of people just like you to create those same benefits for their families through family trusts, so that the fruits of their labour continue to benefit them, then their children, grandchildren, great grandchildren and maybe even a few more generations, often through creating a family property trust and popping your house into the trust.
